PLEASE READ CAREFULLY. THESE TERMS ARE A BINDING AGREEMENT BETWEEN YOU AND NNAKINA XI-AMARU FEARS. BY USING THIS SITE, CONTACTING US THROUGH IT, OR MAKING A PURCHASE, YOU VOLUNTARILY AGREE TO THESE TERMS AND TO OUR PRIVACY POLICY. IF YOU DO NOT AGREE, DO NOT USE THE SITE.

1. About us and our jurisdiction

nnakina.com (the ‘Site’) is the official website of Chief Nnakina Xi-Amaru Fears (‘Nnakina,’ ‘we,’ ‘us,’ or ‘our’), a business established and operating under the jurisdiction of the Xi‑Amaru Republic, an Indigenous autonomous self-governing nation formally established December 17, 2022, whose administrative authority is the Aboriginal Ministry of Justice (AMJ). The Republic’s authority is grounded in the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP, UN Resolution 61/295) and the American Declaration on the Rights of Indigenous Peoples (ADRIP, OAS AG/RES. 2888 (XLVI-O/16)).

The Site presents the work of Chief Nnakina Xi-Amaru Fears as a speaker, educator and author, and sells educational products. Speaking requests are received through the Aboriginal Ministry of Justice. Courses sold on the AMJ website are governed by AMJ’s own terms.

2. Your voluntary agreement

By using the Site, you confirm that you are acting of your own free will, that you have read these Terms and our Privacy Policy, that any information you submit is accurate and provided knowingly, and that you are not relying on any promise that is not written in these Terms or in a written agreement signed by us. Your submission of a message, request or payment is your consent to these Terms.

3. Eligibility

You must be at least 18 years old to make a purchase or submit a request. By doing so, you confirm that you are 18 or older and have the authority to agree to these Terms, including on behalf of any organization you represent.

4. Educational content: not legal advice

EVERYTHING ON THIS SITE, IN OUR PRODUCTS AND IN OUR TALKS IS GENERAL EDUCATIONAL INFORMATION. IT IS NOT LEGAL, FINANCIAL, TAX OR MEDICAL ADVICE, AND IT DOES NOT CREATE AN ATTORNEY-CLIENT, ADVISORY OR FIDUCIARY RELATIONSHIP. Consult a qualified professional about your own situation. You are responsible for your own decisions. See our Disclaimer.

5. Speaking, interviews and media

6. Digital products and purchases

7. No refunds and chargebacks

ALL SALES ARE FINAL. ALL PURCHASES ARE STRICTLY AND UNCONDITIONALLY NON-REFUNDABLE, WITHOUT EXCEPTION, AS SET OUT IN OUR NO REFUND POLICY, WHICH IS PART OF THESE TERMS. By completing a purchase, you confirm that you have read the No Refund Policy and voluntarily waive any claim to a refund.

Initiating a chargeback or payment dispute without first contacting us is a material violation of these Terms. We will provide evidence of your purchase, agreement and delivery to the payment processor, and your license and access to our products may be revoked.

8. Acceptable use

You agree not to: misuse or attempt to gain unauthorized access to the Site; scrape or harvest content with automated tools; upload malicious code; impersonate Chief Nnakina, the Aboriginal Ministry of Justice, the Xi‑Amaru Republic or any official; misrepresent an affiliation with us; or use the Site for any unlawful, harassing or fraudulent purpose.

9. Intellectual property

All content on the Site, including text, photographs, video, the Nnakina logo and diamond mark, designs and products, belongs to Nnakina Xi-Amaru Fears or its licensors and is protected. The names, seals and symbols of the Xi‑Amaru Republic and the Aboriginal Ministry of Justice belong to them. You may share links to the Site and quote short passages with credit. Any other use requires our written permission.

10. Third-party sites and services

The Site links to other websites, including AMJ, the Xi‑Amaru Republic, news outlets and social platforms, and uses third-party service providers to operate checkout, payments and other functions. We are not responsible for their content, policies or availability, and your use of them is subject to their terms.

11. Testimonials and results

Any testimonials or examples reflect individual experiences and are not a guarantee of any result. We make no promise that our content or products will produce any legal, financial or personal outcome.

12. Disclaimer of warranties

THE SITE, ITS CONTENT AND OUR PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. We may change, suspend or discontinue any part of the Site at any time.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED, NNAKINA XI-AMARU FEARS AND HER AGENTS, CONTRACTORS AND PARTNERS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, DATA OR OPPORTUNITIES, ARISING FROM YOUR USE OF THE SITE, OUR CONTENT, OUR PRODUCTS OR OUR TALKS. Our total liability for any claim will not exceed the amount you paid us for the product giving rise to the claim, or US$100 if you paid nothing.

14. Indemnification

You agree to indemnify and hold harmless Nnakina Xi-Amaru Fears and her agents, contractors and partners from any claims, losses and costs, including reasonable attorney’s fees, arising from your use of the Site or products, your violation of these Terms, or your violation of any law or the rights of others.

15. Disputes and governing law

If a dispute arises, you agree first to email info@nnakina.com with a written description. We will respond within 30 days and try in good faith to resolve it.

Nnakina operates within the jurisdiction of the Xi‑Amaru Republic, and these Terms are made and interpreted under that jurisdiction. Consistent with the Terms of the Aboriginal Ministry of Justice, any dispute not resolved informally will be resolved by binding arbitration on an individual basis, and any matter brought before an outside forum is governed by applicable federal law and the laws of the State of Tennessee, with venue in Tennessee. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE OR REPRESENTATIVE ACTION. Any claim must be brought within one (1) year after it arises, or it is permanently barred.

16. Termination

We may suspend or end your access to the Site or your product license at any time for a violation of these Terms. Termination does not entitle you to a refund. Sections 4, 6–7, 9 and 11–17 survive termination.

17. General

These Terms, our Privacy Policy, No Refund Policy, Cookie Policy and Disclaimer, and any written engagement agreement form the entire agreement between you and us. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You consent to receive notices and receipts electronically, and they have the same effect as signed paper documents. We may update these Terms. Continued use after an update is posted means you accept it.
